The Biden administration on Friday repealed a public health order imposed by former President Donald Trump allowing Border Patrol to limit the number of asylum seekers due to health risks — and the White House says it is preparing for a surge in migrants as a result of the policy change.

The American Civil Liberties Union, Oxfam America and other civil rights organizations in 2020 filed a lawsuit against Title 42, arguing the government was misusing public health authorities to unfairly expel migrants. After unsuccessful negotiations with the Biden administration, the organizations went back to court in July 2021 to seek a termination of the policy. A federal appeals court last month ruled that the administration could continue to turn away migrant families but only to countries where they wouldn’t face persecution or torture, according to Axios.
